1. Acceptance of Terms

By accessing the Fuoco Antico online ordering storefront, creating or signing in to a customer loyalty account, or placing an order with Fuoco Antico, operated by Bananas Entertainment LLC (“Fuoco Antico”, “Bananas Entertainment LLC”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions and our Privacy Policy.

2. Online Ordering, Pricing & Pickup

• Pickup Orders: All orders placed through our website are for in-person pickup at our restaurant located at 815 Chicago St, Green Bay, WI 54301, unless otherwise stated.
• Preparation Windows: Estimated pickup times are provided based on real-time wood-fired oven capacity and current kitchen volume. While we strive to meet every selected pickup window, actual preparation times may vary during peak service hours.
• Pricing & Taxes: Menu prices are listed in US Dollars (USD) and are subject to applicable Wisconsin state and local sales taxes (5.5%).
• Order Modifications & Cancellations: Because dishes are prepared fresh to order in our wood-fired oven, please call us immediately at (920) 367-1712 if you need to modify or cancel an order that has already been submitted.

3. Fuoco Antico SMS Messaging Terms & Conditions (Transactional Only)

• How to Opt In: Customers opt in at checkout on https://fuocoantico.com by entering their 10-digit mobile phone number and checking the unchecked-by-default box labeled: “By checking this box and providing your mobile phone number, you expressly consent to receive transactional SMS text messages from Fuoco Antico (operated by Bananas Entertainment LLC)...” or by entering their mobile number in the Sign-In modal, checking the SMS consent box, and requesting a 6-digit one-time passcode.
• Consent Not a Condition of Purchase: Consent to receive SMS text messages is completely voluntary and is not a condition of any purchase or order placement.
• Message Frequency: Message frequency varies based on your ordering and sign-in activity (typically 2–4 transactional messages per pickup order, plus 1 message per requested sign-in verification code).
• Message & Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, please contact your wireless provider.
• Opt-Out Instructions (STOP): You can cancel the SMS service at any time. Just reply STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) to any text message you receive from us at (920) 367-1712. After you send the SMS message STOP to us, we will send you a one-time confirmation SMS confirming that you have been unsubscribed. After this, you will no longer receive SMS messages from us unless you explicitly opt in again by replying START or checking the SMS consent box on a future order.
• Help & Support Instructions (HELP): If you are experiencing issues with the messaging program or need assistance, reply with the keyword HELP to any message for more information, or contact us directly at info@fuocoantico.com or by calling (920) 367-1712.
• Carrier Liability Disclaimer: Wireless carriers are not liable for delayed or undelivered messages.
• Strict Mobile Privacy & Non-Sharing Guarantee: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will never be sold or shared with any third parties, excluding aggregators and providers of the Text Message services. 4. Fuoco Antico Loyalty Program (“Sparks”)

Customers who provide a valid 10-digit mobile phone number earn loyalty points (“Sparks”) on qualifying pickup orders. Loyalty points have no cash value, are non-transferable, and may be redeemed only toward eligible rewards as published on our storefront.

5. Limitation of Liability & Disclaimer

Our online ordering website and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Fuoco Antico and Bananas Entertainment LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of our online storefront. Please notify our kitchen staff directly of any severe food allergies prior to ordering.
